Kenya has in the past years witnessed tremendous growth in music with groups like Sauti Sol being feted on International platforms, artistes like Nyashinski and Khaligraph also making it to the AFRIMA nominations list this year.

Unfortunately the growth in the continental and national music has not been in tandem with the growth of artistes.

While local media houses grow their ratings and audiences by playing the great music produced and done by the Kenyan artistes, most of them are not giving back by paying royalties to the Music Copyright Society.

This is despite other countries in Africa registering steady growth in royalty collection.

Royalty payment has in the recent past caused an uproar among the artistes who are oblivious of the challenges that the copyright group is facing in collecting royalties.

At the funeral of Musician John DeMathew’s funeral President Uhuru Kenyatta to honour the artistes by paying their royalties.

And as Kenya joins the rest of the continent in marking the Africa Copyright And Management Day, the Music Copyright Society is on Saturday planning to visit various media houses to engage them on the status of royalty collection and the importance of paying royalties.

“This is the second edition of Africa Copyright and Collective Management Day. This day is celebrated to draw attention to the vibrant contributions of creators and copyright to the lives of millions throughout Africa and beyond,” said MCSK CEO Micah Kulati.

Accompanying the MCSK officials to the media houses will be at least 20 artistes including MCSK Ambassador and Julius Owino popularly known as Majimaji.

“There s need to get copyright laws and gains to improve the lives of musicians across Africa and we can only do this by creating awareness tomorrow on need the need to pay royalties,” said Majimaji.

“#TheMusicBusKE will see artistes play very loud music in a very hot matatu (Nganya) to create music awareness. So I call on all the other musicians to join us in the hashtag and help us create the awareness,” said Majimaji.

Under the hashtag #TheMusicBusKE the team will seek to engage the media managers in a round table talk in a bid to get them realise the need of dutifully paying the royalties.

Some of the media houses MCSK is planning to visit are Radio Africa Limited, Royal Media services, Nation Media Group, Media Max and the Standard media Group.

14 September 2019, as Africa marked the 2nd annual African Copyright and Collective Management Day Collective management organizations were joined by artist ambassadors  in a special media tour to petition music users and consumers to pay for royalties.

The day is celebrated by 21 countries in Africa alone and is aimed at drawing attention to the vibrant contributions of music creators and creating awareness on importance of copyright for the millions of creative works throughout Africa and beyond.

The coordinated event is supported at global level by CISAC, the largest worldwide network of authors societies, with members in over 120 countries.

In Kenya, the Music Copyright Society of Kenya (MCSK) marked the day by doing a door to door media call for music users to pay for royalties.

MCSK ambassadors among them popular rappers Octopizzo and MajiMaji all had one message for music consumers, which was to respect musical arts just like any other profession and pay for contents they use.

Octopizzo

MCSK CEO Milcah Kulati who led the team on the media tour, said the joint CMOs decided to celebrate this day by ensuring the body received proper media coverage to properly communicate the need to support artists countrywide.

“Africa is the leading continent where musicians are still not appreciated compared to other continents. So today as we mark the Africa Copyright day, we decided to do a door to door media tour to explain to our audience and music consumers the need to support our artistes. In this day music is a profession like no other so we cannot be consuming content produced by our artistes and not pay for it. This is their source of income and we need to appreciate their hard work. So to mark this day we decided to visit our big media houses send out this message” she said

Kulati also added that the body will be holding a regional training for artistes in order to best explain how the body works.

The need for communication between the joint CMOs and artistes was witnessed recently when a section of artistes took to social media to air out the frustrations regarding the controversial Kes 2530 sent out to every registered members.

The artistes led by Khaligraph Jones called out MCSK for paying them peanuts which at the end turned out to be an equal amount general distribution to every artiste.

“When our artistes took to social media most pf them did not understand that the money was a general distribution, an equal amount we sent to all our registered members but because of that communication gap, we are planning an Annual General Meeting as well as regional training to enable our members to understand the importance of their participation as well as how we carry our distribution. Next month we will be having a scientific distribution and we hope this time things will go smoothly.” She added

Rapper Octopizzo also called on artistes to work together with CMOs to ensure the growth of artistes in Kenya.

“Some of US are always ready to run to social media to castigate MCSK but when we receive lots of money from them we remain silent. Truthfully the last two years ushered in change for artistes and CMOs but we need to work together. Musicians have power, without us there would be no MCSK. We really need to understand how the body works and give them a chance to serve us.” He said

African Copyright and Collective Management Day was marked by countries like

Benin,Burkina Faso,Cape Verde,Djibouti,Ivory Coast,Madagascar,Malawi,Tanzania,Uganda,Zambia,Zimbabwe among others.

Among the media houses that the team paid a visit are Radio Africa Group where they were hosted on Radio Jambo, Royal Media Services, Standard Group and Nation Media group.

Under the hash tag #TheMusicBusKe the team also shared the message on the need to support artistes across social media platforms.

Through a post on his YouTube channel, the singer revealed that he landed in Nairobi on Sunday and is now feeling much better.

“Feels great to be back home! There’s nothing like it, being where you belong, with the people you belong! And better still, feeling healthier! Nashukuru sana” wrote Jimmy Gait.

Jimmy Gait flew to India in August to seek treatment after going through a cancer scare.

The singer had revealed that he was suffering from a mysterious condition and was asked by his Kenyan doctors to seek treatment in India.

“I have not been well, I have been battling a condition and gone to quite a number of hospitals and it has been decided that I have to go out of the country for special treatment and medical attention,” he said at the time.

After several tests by his Indian doctors, Jimmy Gait was  found to be suffering from excess acid production in the stomach.

“We found the infection, we treated it, we are still treating it and luckily we are doing well with the treatment. This is my advice to doctors if a patient is not showing any progress maybe one time or two times, move according to the clinical judgment and do perform the tests which are required,” his doctor Sanjay Khan said

Rapper Kristoff has now sought legal action against upcoming artistes Effect Gang after they alleged he stole their song.

The song which premiered on Youtube on September 13 has been the subject of controversy with the upcoming artistes claiming they are the original owners of the song.

Kristoff has since rubbished the claims arguing that he has never met Effect Gang.

He also added that the song was recorded four months ago, and the video shot sometime in August therefore he couldn’t have stolen it.\

“BASH was scripted and recorded 4 months ago, May 2019 to be precise. The video was shot in August 2019 and a trailer announcing the release was published on September 12th 2019. It is a copyrighted track under KECOBO. The story has been one –sided all through, how would I steal a song of people I had never seen or heard before in my life?” he said

Through his lawyer James T Makori advocate, Kristoff is now demanding an apology from the new artistes.

In an earlier statement, Kristoff’s team had told Effect gang to withdraw their statement failure to which legal action would be taken.

“Kristoff’s management has not taken the allegations politely as such indictment is jeopardizing to their clients’ brand and want the ‘gang’ to withdraw their statement or legal pursuit will be taken up. There are better, mature and professional ways to get attention and collaborations for upcoming artists looking to merge with growing and/or established artists.” Read part of the statement
