Popular Kenyan artist Krispah Ndovu Kuu has got his hit song ‘Ndovu Ni Kuu’ back on YouTube after being pulled down.
The rapper took to Instagram sharing the news with his followers showing that it was a false copyright infringement that was overturned.
His legal team put to task the complainant ‘Dexta’ wondering why he hadn’t lodged his claims in the first month when the song trended on several social media platforms.
After the perpetrator was summoned and shown what was in store for him under the copyright act, a fine of Ksh. 500,000 followed by a jail term not exceeding 5 years, he agreed to withdraw the false claims.
“As a professional artist, Ndovu Kuu sought legal counsel with us, and we immediately wrote a demand letter asking Dexta to withdraw the false and misleading claim and restore our client’s content. It is an offence under the copyright Act section 35B(8)and has criminal sanctions of a fine not exceeding Ksh. 500,000 or imprisonment of a term not exceeding 5 years or both,” read part of the statement.

It further stated that no compensation was made towards the party (Dexta)as he had no entitlement to the song, he has also been warned to desist from making other false claims to the public.
And in ending the animosity that was brewing Ndovu Kuu distanced himself from sueing him for the wrong doing.
“Our client has extended an olive branch to Dexta and will not sue him both for criminal and civil wrongs for as long as he refrains from making false statements and he sets the record straight,” further read the statement.
Ndovu Kuu has thanked his fans for the support and urged fellow artists to conduct themselves professionally.
Ealier Ndovu Kuu had cited Kenyatta University for his woes as the institution said the song impacts negatively on its student intake with the line.
“Hakunanga masomo K.U… Mtoto wangu akiitwa K.U ntakataa”.
